1. GENERAL PROVISIONS

Acceptance: User registration or submission of data for a tour implies full and unconditional acceptance of this Agreement.
Amendments: The Administration reserves the right to amend the Agreement without prior notice. The new version comes into effect from the moment of publication.
The Service: Provides access to a platform for searching, viewing, and booking tourism services ("Tours").

2. SCOPE OF THE SERVICE

The Administration acts as a licensed tour operator, ensuring seamless data transfer between the User and direct service providers or government authorities.

3. VISA SUPPORT AND DOCUMENTATION

LOI Support: The Administration provides Letter of Invitation (LOI) support based on data provided by the User.
User Responsibility: The User is personally responsible for the accuracy of their passport data.
Visa Rejections: The Administration is not liable for visa rejections resulting from inaccurate information provided by the User.
Final Decision: The decision to grant a visa rests solely with the State Migration Service of Turkmenistan.

4. BOOKING AND PAYMENT RULES

Group Tours: Pricing is based on the final number of participants; costs may be adjusted if minimum group sizes are not met.
Cancellation Fee: Once an LOI application is submitted, a non-refundable administrative fee of $30 USD applies.
Secure Payments: Payments are processed through third-party gateways like Stripe. We do not store full credit card details.

5. LIMITATION OF LIABILITY

Third Parties: The Administration is not responsible for the quality of services provided by hotels or airlines but will assist in resolving disputes.
Schedule Adjustments: We reserve the right to optimize itineraries based on arrival times and professional guide advice.
Damages: TMTOURISM LLC is not liable for indirect or incidental damages arising from tour participation.

6. PRIVACY POLICY: INFORMATION WE COLLECT

To provide tourism services and process official permits in Turkmenistan, we collect the following:

Identification Data: Full name, nationality, and passport scans required for LOI and State Migration Service registration.
Contact Information: Email address, phone number, and messaging app handles.
Travel Details: Flight schedules, hotel preferences, and dietary or medical requirements.

7. DATA PROCESSING & PROTECTION

Purpose: Data is used exclusively for official document support, service fulfillment, and secure communication.
Third Parties: We share data only with Governmental Authorities (Migration Service) and direct Service Providers (Airlines, Hotels). We never sell your data.
Security: We use encrypted communication channels. Sensitive files like passport scans are securely deleted upon request after legal retention periods.

8. REFUND AND CANCELLATION POLICY

Standard Cancellation: Cancellations made 48 hours or more prior to the tour start are eligible for a full refund (minus non-refundable LOI fees).
Late Cancellation: Cancellations made less than 48 hours prior, or no-shows, are not eligible for a refund.
Company Cancellations: If we cancel due to weather or safety, you receive a choice of rescheduling or a 100% full refund.
Refund Processing: Approved refunds are processed to the original payment method within 5-10 business days.

9. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law principles.
